Welcome to Bestie ("we," "our," or "us"). By accessing or using our website (getmybestie.com) and the MyBestie companion service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract under UK law.
Bestie is an artificial intelligence companion designed for conversational and entertainment purposes. It utilizes third-party Large Language Models (LLMs) and Vision-Language Models (VLMs) to generate text-based responses and process images.
Free Tier: All users receive a limited number of free messages per day. To unlock unlimited messaging, you must subscribe to a paid plan.
Billing: Subscriptions are billed on a recurring monthly basis via our payment processor, Stripe.
Cancellations: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. We do not provide refunds for partial months.
You retain all ownership rights to the text and images you upload to the Service ("User Content"). By submitting User Content, you grant us a secure, non-exclusive, royalty-free license to process this content strictly for the purpose of operating the Service and generating AI responses. We do not use your User Content to train underlying AI models.
To ensure the quality and availability of the Service for all users, your use is subject to our Fair Usage Policy.
Fair Usage: The Service is designed for normal, personal conversational use. We reserve the right to monitor usage patterns. If we determine, in our sole discretion, that your usage is excessive, disproportionate, or placing an undue burden on our infrastructure (e.g., through automated scripts, botting, or continuously pasting massive blocks of text), we may temporarily limit your access, throttle your message rate, or terminate your account.

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, violation of the Fair Usage Policy, or suspected fraudulent activity. If your account is terminated for abuse, you will not be entitled to a refund.
Not Professional Advice: Bestie is an AI, not a human. The Service is provided for entertainment purposes only. The AI's responses do not constitute medical, psychological, legal, or financial advice. You should not rely on the AI for emergency situations or professional guidance.
"As Is" Basis: The Service is provided "as is" and "as available." AI models can occasionally hallucinate, make errors, or produce inaccurate or inappropriate responses. We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of the AI's output.
To the maximum extent permitted by applicable law (including the laws of England and Wales), in no event shall Bestie, its founder, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use or inability to use the Service. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the past 12 months.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
